Cloudbase Terms & Conditions

Acceptance of Terms

These Terms & Conditions apply to the Cloudbase app for iPhone and related Cloudbase support and legal experiences operated by Token Trade Games Ltd. By downloading, accessing, or using Cloudbase, you agree to these terms. If you do not agree, do not use Cloudbase.

License and Acceptable Use

• We grant you a limited, non-exclusive, non-transferable, revocable license to use Cloudbase for your personal, lawful use.
• You must not copy, modify, translate, distribute, sell, lease, sublicense, or create derivative works from Cloudbase except where applicable law gives you that right despite this restriction.
• You must not reverse engineer, decompile, or attempt to extract source code from Cloudbase except where applicable law permits it.
• You must not interfere with the app, scrape or overload the service, bypass security measures, misuse automated access, or use Cloudbase for unlawful, harmful, or infringing activity.
• All trademarks, copyrights, database rights, and other intellectual property rights in Cloudbase remain the property of Token Trade Games Ltd or its licensors.

Service Availability, Connectivity, and Updates

• Some Cloudbase features require an active Internet connection and depend on your device, operating system, network provider, and third-party services.
• You are responsible for carrier charges, roaming fees, Wi-Fi availability, and keeping your device charged and capable of running the app.
• We may update, change, suspend, or discontinue features at any time. You may need to install updates to continue using some or all of Cloudbase.
• We do not guarantee that Cloudbase will always be available, uninterrupted, error-free, or compatible with every device or OS version.

Fees and Paid Features

Cloudbase is currently offered as a free service. We may introduce paid features or services later. If we do, we will clearly disclose pricing, billing terms, and any material purchase conditions before you are charged.

Weather and Aviation Information

• Cloudbase provides weather, radar, air quality, and aviation-related information for general informational use only.
• That information may be delayed, unavailable, incomplete, or inaccurate, and may change without notice.
• Do not use Cloudbase as the sole basis for flight, navigation, safety-critical, emergency, dispatch, or other operational decisions.
• You remain solely responsible for using independent judgment and consulting official sources, certified systems, and required briefings where appropriate.

Third-Party Services

• Cloudbase relies on third-party providers for hosting, analytics, weather and aviation data, and support communications, including Cloudflare, Plausible Analytics, Open-Meteo, NOAA / NWS services, and Google Workspace / Gmail.
• Those providers operate under their own terms, privacy policies, and service conditions.
• We are not responsible for outages, errors, policy changes, or availability issues caused by third-party services or data providers.

Privacy

Our collection and use of information in connection with Cloudbase is described in the Cloudbase Privacy Policy. By using Cloudbase, you acknowledge that information may be handled as described there.

Disclaimers and Limitation of Liability

• To the maximum extent permitted by applicable law, Cloudbase is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
• We disclaim, to the maximum extent permitted by law, implied warranties such as merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
• To the maximum extent permitted by law, Token Trade Games Ltd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business, goodwill, or use arising from or related to Cloudbase.
• To the maximum extent permitted by law, we are also not liable for losses arising from your reliance on weather or aviation information, service interruptions, connectivity failures, device issues, third-party service failures, or unauthorized access beyond our reasonable control.

Suspension and Termination

• We may suspend, restrict, or terminate your access to Cloudbase if we reasonably believe you are misusing the service, violating these terms, creating risk, or where required for legal or security reasons.
• We may also stop offering Cloudbase, in whole or in part, at any time.
• You may stop using Cloudbase at any time. If these terms end, the rights granted to you end as well, and you must stop using the app.

Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will post the revised version and update the effective date below. Your continued use of Cloudbase after the revised terms take effect means you accept the updated terms.

Governing Law

To the extent permitted by applicable law, these Terms & Conditions and any dispute arising out of or relating to Cloudbase are governed by the laws of Canada, without regard to conflict of laws principles.
